Dakota County Marriage and Divorce Records

Dakota County marriage and divorce records sit in two different systems. Marriage licenses and certified marriage certificates are county vital records, handled by Dakota County service and license centers. Divorce records are court records, called Dissolution of Marriage under Minnesota law, filed in District Court. A Dakota County marriage records search and a Dakota County divorce records search use different portals and different offices. Each carries its own application form, fee, and residency rule. Knowing which path to take saves time and avoids the common mistake of asking the wrong office for the wrong record.

Dakota County Marriage License Application

Dakota County marriage licenses are handled by Dakota County Marriage Licenses & Certificates, not the District Court. A license obtained anywhere in Minnesota is valid for a Minnesota ceremony. After issuance, the license is valid for six months. The county supports both online and walk-in workflows: complete the online application, receive a confirmation number, and reserve an appointment at one of three locations. Walk-ins are available but appointments are encouraged. The official county page is at co.dakota.mn.us/Permits/MarriageLicensesCertificates/Licenses.

Both applicants must sign the application. In most cases both must be present at signing, but exceptions exist under Minn. Stat. 517.08. Dakota County asks readers to email nscservicedesk@co.dakota.mn.us or call 651-554-6531 to confirm whether both parties are required. Under Minn. Stat. 259.13, a person with a felony cannot change their name using a marriage license alone and must follow extra legal steps.

  1. Open the Dakota County marriage license page and start the online application.
  2. Complete the online form and save the confirmation number.
  3. Reserve an appointment at the Administration Center in Hastings, the Northern Service Center in West St. Paul, or the Western Service Center in Apple Valley.
  4. Bring proof of age: original or certified birth record, driver's license or government/school ID, or another government or school document showing birth date.
  5. Both applicants sign the application; exceptions under Minn. Stat. 517.08 may apply.
  6. Pay $125 for the standard license or $50 with 12 hours of premarital education and a signed statement on educator letterhead.
  7. After issuance, the license is valid for six months for a ceremony anywhere in Minnesota.

Dakota County Marriage Certificates

The official Dakota County marriage certificates page describes how the certificate is recorded and how certified copies are issued. The person performing the marriage fills out the certificate and must file it with the Administration Center, Northern Service Center, or Western Service Center within five days. A certified copy is mailed to the newly married couple. Dakota County keeps marriage records only for licenses issued in Dakota County. Additional certified copies cost $9 each and can be purchased in person, by mail, drop box, or email with the Marriage Certificate Application and payment.

The certificates page also covers amendments. Missing information, misspelled names, and the date or place of marriage can be amended; last-name changes after marriage require a District Court order rather than a certificate amendment.

The statewide Minnesota Official Marriage System (MOMS) is the statewide marriage certificate search system, useful when the license was not issued in Dakota County. Marriage license application is governed by Minn. Stat. 517.08, and certified marriage certificate copies by Minn. Stat. 517.101.

Dakota County Marriage Record Amendments

An amendment is the correct path when a recorded marriage record has wrong or missing data. The county allows amendments for missing information, misspelled names, and the date or place of marriage. The amendment fee is $40 and is nonrefundable. The amendment is filed at one of the three service centers and is processed by Vital Statistics. Supporting documents in languages other than English must be translated, and the translator must complete a Certificate of Translation Form provided when the request is submitted.

For a post-marriage name change, an amendment is not the right tool. A District Court order is required. The marriage license itself can carry a name change for non-felony applicants, but a felony record blocks the marriage-license name change under Minn. Stat. 259.13.

Dakota County Divorce and Dissolution Records

Minnesota calls divorce "Dissolution of Marriage." Dissolution is a District Court matter. To file in Minnesota, at least one spouse must have lived in Minnesota for 180 days, or a qualifying armed-forces residency rule must apply, under Minn. Stat. 518.07. Forms are filed in the District Court of the county where one spouse lives. The Minnesota Judicial Branch describes the process at the divorce help topic page.

The Judicial Branch's divorce help topic sets the framework: dissolution can take several months, it is more complicated than getting married, and forms differ for cases with or without children.

For Dakota County dissolution records, search MCRO Case Search under the Family category. MCRO limits online family documents mostly to court-generated items: orders, appellate opinions, and notices filed on or after July 1, 2015. Certified copies of a Dakota County dissolution order come from Dakota County District Court Administration at 651-377-7180.
